1. About OUTPLAY
OUTPLAY is a trade name operated by Saqlain Yousuf, sole proprietor. These Terms govern use of outplaycricket.com and purchases made from OUTPLAY. The store is hosted on Shopify, which provides the commerce platform used to offer products and process store activity.
By using the website or placing an order, the customer agrees to these Terms, the Privacy Policy, Return and Refund Policy, Shipping Policy, and any product-specific conditions clearly displayed before purchase.
2. Eligibility and customer information
Customers must be legally capable of entering into a purchase contract or must use the store with the involvement of a parent or legal guardian where required by law. Customers must provide accurate billing, payment, contact, and delivery information and must be authorized to use the selected payment method.
3. Products and natural variation
OUTPLAY aims to describe and display every product accurately. Screen settings, photography, and the natural character of willow can cause reasonable differences in colour, grain, shade, and cosmetic appearance. Natural variation is not a defect when the product remains safe to use and materially matches its advertised description.
Product availability, specifications, and prices may change before an order is accepted. A confirmed order will be handled according to the information presented and accepted at the time of purchase, subject to correction of an obvious error and the customer's applicable rights.
4. Product use
The founding bat is designed for hard-tennis balls, soft-tennis balls, and lightweight synthetic balls. It is not designed for leather balls, heavy synthetic balls, or similarly hard or heavy balls. Customers must follow product-use and care guidance displayed on the website or supplied with the product.
OUTPLAY is not responsible for damage caused by misuse, incompatible balls, deliberate impact, unauthorized modification, poor storage, or normal wear. This does not exclude responsibility for a confirmed manufacturing defect or any responsibility that cannot lawfully be excluded.
5. Orders and acceptance
Placing an order is an offer to purchase. An order is accepted when OUTPLAY confirms it and the required payment or INR 500 partial-COD advance has been successfully received. OUTPLAY may reject or cancel an order for a legitimate reason, including unavailable stock, an obvious pricing error, suspected fraud, an unsupported delivery address, or inability to fulfil the order. If OUTPLAY cancels an order after receiving payment, the amount received will be refunded.
6. Prices, taxes, shipping, and payments
The product price, applicable tax, shipping charge, discount, and compulsory fee will be shown before the customer confirms the order. Founding Batch delivery is free for the first 100 bats. From Batch 2 onward, shipping will be calculated and displayed at checkout.
Customers may pay the full amount through an available online method or use partial cash on delivery when offered. Partial COD requires INR 500 at order placement, with the remaining confirmed amount payable on delivery.
Payment processing is also subject to the terms and availability of the relevant payment provider. OUTPLAY does not store full payment-card credentials directly.
7. Dispatch, delivery, cancellation, returns, and refunds
Dispatch, delivery, cancellation, return eligibility, return-shipping costs, partial-COD deductions, replacements, and refunds are governed by the Shipping Policy and Return and Refund Policy. Those policies form part of these Terms.
8. Warranty
OUTPLAY does not provide a separate long-term commercial warranty at launch. Confirmed manufacturing defects reported under the Return and Refund Policy are eligible for the remedies stated in that policy. This clause does not limit a statutory guarantee, warranty, or consumer remedy that applies under Indian law.
9. Website use and intellectual property
The OUTPLAY name, branding, original text, photography, graphics, video, and website presentation may not be copied, republished, sold, or commercially exploited without permission, except where use is permitted by law. Customers must not misuse the website, interfere with its operation, attempt unauthorized access, submit malicious code, or use it for unlawful activity.
10. Reviews and customer submissions
A customer who voluntarily submits a review, photograph, suggestion, or other content confirms that the submission is truthful, lawful, and does not infringe another person's rights. OUTPLAY will not use a customer's personal image for advertising without the permission required by applicable law.
11. Third-party services and links
The store may depend on third-party services such as Shopify, payment providers, analytics services, and couriers. Their availability and separate terms may apply to the services they provide. A third-party link does not by itself mean that OUTPLAY controls or endorses everything on the linked website.
12. Privacy
Personal information is handled according to OUTPLAY's Privacy Policy. Customers should review that policy to understand how information is collected, used, shared, and protected in connection with the store and Shopify platform.
13. Liability and consumer rights
Nothing in these Terms excludes or limits liability or a consumer remedy that cannot lawfully be excluded or limited. Subject to that rule, OUTPLAY is not responsible for indirect or consequential loss that was not reasonably foreseeable from a breach attributable to OUTPLAY.
14. Governing law and disputes
These Terms are governed by the laws of India. Courts and consumer authorities with lawful jurisdiction may hear disputes. Nothing in this clause prevents a consumer from using a consumer commission, grievance process, or other forum available under applicable law.
Customers should first contact OUTPLAY using the details below so the business has an opportunity to resolve the issue promptly.
15. Changes to these Terms
OUTPLAY may update these Terms prospectively when its products, operations, or legal obligations change. The version displayed when an order is placed will normally govern that order, unless a later change must apply by law or is more favourable to the customer.
